Terms and Conditions of Sale.

These terms and conditions apply to all transactions from Philter Limited, 5, Marlpit Cottages, Heath Road, Boughton Monchelsea, Maidstone, Kent. ME17 4JN. The placing of an order indicates your acceptance of these terms and conditions. Please read them carefully. Please print a copy for future reference.

These terms and conditions do not affect your statutory rights. To order goods, you must be at least 18 years of age. We will treat each order by you as an offer to purchase the goods subject to these terms and conditions.

We reserve the right to refuse to supply any goods ordered by you.

Description of Goods / Warranty and Liability.

Although we warrant that the goods will, at the time of delivery, correspond to the description given by us, due to the nature of the products and their continual development, it is not practical to publish technical details. Please refer to the manufacturers website or brochure before ordering. Goods are not sold on a trial basis and, except where the customer is dealing as the consumer (as defined in the Unfair Contract Terms Act 1977, Section 12) all other warranties, conditions or terms rellating to fitness for purpose, merchantability or condition of the goods, whether implied by statute, common law or otherwise are excluded and the customer warrants that he/she is satisfied to the suitability of the goods for his/her purpose.

Product Images and Specifications.

We do endeavour to display the correct image for a particular product. However, the shape or specification for that product may change without an image being available for publication, in which case we will display the last available image for that product.

Payment.

This is a UK site only. Orders are for UK Mainland delivery only. Please pay using the (Paypal) link next to the product you wish to order. Email us with a sales enquiry if you wish. Until full payment has been received, Products remain the property of Philter Limited.

Availability.

All products are subject to availability and may be withdrawn at any time. We will contact you if a product is unavailable to see if you would like to cancel that order.

Delivery.

Whilst every reasonable effort shall be made to keep to any delivery date, time of delivery shall not be of the essence and we shall not be held liable for any losses, costs, damages or expenses incurred by the customer or any other person or company arising directly or indirectly out of the failure to meet any estimated delivery date.

Delivery of the goods shall be made to the customers address and the customer shall make all arrangements necessary to take delivery of the goods whenever they are tendered for delivery.

We will deliver to the address tendered by your credit/debit card company unless you have made and agreed with us an alternative delivery address in writing.

Uncontrollable Events and Delays.

In the case of delays caused by circumstances beyond the control of Philter Limited, Philter Limited shall have the right to suspend delivery or cancel the contract without liability.

Examples of uncontrollable events are:- strike, lockout, war, revolution, riot, epedemic, fire, transport or working difficulties, failure of suppliers etc. This list is not exhaustive.

Customers Obligations.

You are responsible for your choice of product and its suitability for your purpose. You must ensure that any products are compatible.

Time Limitations and Notification of Claims.

Damage in Transit.

All tanks should be checked visually upon delivery and any damage reported to the driver with rejection of goods for damage reason at this point in time. Advance kits should be opened and inspected at point of delivery.

Shortages.

It is the customers resposibility to sign for the correct number of packages. Any shortages should be noted on the drivers manifest and it is the customers responsibility to notify us within 48 hours of any shortage.

Incorrect Goods.

The customer must notify us within 48 hours if incorrect goods have been supplied. Order form and invoicing will be checked and a

re-stocking charge of 25% will be levied if the customer has ordered the incorrect goods.

Product Guarantees.

All products supplied are covered by the terms and conditions of the original manufacturers guarantee for a period of 12 months or longer if relevant, this is in addition to the consumers statutory rights. Product covered by a direct warranty from the manufacturer is not covered by this guarantee. The customer will receive a warranty direct from the manufacturer and should claim under this warranty.

Cancellation of Orders.

Orders cancelled after dispatch of the goods will be subject to credit only once the items have been returned to us. You must inform Philter Limited in writing and return the products to us immediately, in the same condition you received them, at your own cost and risk. The customer will be responsible for the safe return of the goods. Goods must be returned in the condition they were received in, there should be no damage and all parts and manuals should be returned. A re-stocking fee of up to 25% may be charged. This charge, when levied, is non negotiable.

Faulty Goods.

If you feel that the product you have purchased is faulty, we will refer you to the manufacturer, who, may in turn, elect to send an engineer to inspect the product before accepting its return or remedy.

Refunds.

Where possible, should the need for a refund apply, we shall refund to the card from which the payment was first issued. You will be sent notification by e-mail.

Liability.

Except as may be implied by law and except in the case of death or personal injury where the customer is dealing as a consumer, in the event of any breach of these terms and conditions by us the remedies to you shall be limited to damages which in no circumstances shall exceed the price of the goods and we shall under no circumstances be liable for any indirect, incidental or consequential damages.

Force Majeure.

We will not be under any liability whatsoever in the event that we are prevented or delayed from supplying or making delivery of any goods by any reason or cause beyond our control.

No Waiver.

Our failure to insist upon strict performance of any provision of these terms and conditions shalll not be deemed to be a waiver of our rights or remedies in respect of any present or future default of the customer in performance or compliance with any of these terms and conditions.

Severability.

In the event that any of these terms and conditions shall be determined invalid, unlawful or unenforceable to any extent, such term, condition or provision shall be severed from the remaining terms and conditions which shall continue to be valid and enforceable to the fullest extent permitted by law.

These terms and conditions shall be construed in accordance with English Law.
